I used opus to produce a tickertape banner for a web site to great effect
my only issue is:

When I selected none as a background I expected the swf file to maintain the transparency but it replaced it with black

Is there something that i am doing that is wrong

Try this and see if it has any effect:

Go into your HTML code for the page where you have the Flash object.

In the OBJECT section add the following below to a line somewhere in the OBJECT coding.
<param name="wmode" value="transparent">

In the EMBED section, add the following to it:
wmode="transparent"

This should give you a transparent Flash background. If not, then something's up with your Flash output.

No good
to be honest
I am not sure where to insert the info that you so kindly wrote
I located what i thougt were the object and embed sections
and pasted in but the swf file played with a black background

I tried that and it works fine.
I attach the example (intro.swf and intro.html) and the imp-file I built.
It's in Opus Pro XE 5.14.

Just checked the attachment
it still has a black background
which is what i have on my swf file
although i selected the background to be transparent

what i am looking for is a transparent background
i.e. just the logo minus the black

When I run Oscar's sample, I see his logo on a transparent background. The logo itself has a black background which is displayed on a transparent background in the Opus pub. The HTML window mode parameters setting for the Flash movie works for setting the movie's background to transparent in most browsers.
There's more information on setting the transparency of a Flash movie at Macromedia's site http://www.macromedia.com/cfusion/knowledgebase/index.cfm?id=tn_14201

in the end i have got around this by making the page background in opus
the same colour as the page of the website that i am putting it on
whenever i tried your examples it put the logo on black
that is if the background is set to transparent in opus
it publishes the swf file with black as the background
